The Canada Post Corporation (CPC) has increased the number of bar code sorters (BCS) at the Vancouver Plant without first providing the Canadian Union of Postal Workers (CUPW) with the notices outlined in clause 29.03. The Union hasn't received relevant information on the nature of the change, the date on which the Corporation proposes to implement the change, the approximate number, type and location of employees likely to be affected by the change, the effects the change may be expected to have on the employees' working conditions and terms of employment and all other relevant data relating to the anticipated effects on employees. In doing so, CPC refused to apply the provisions of Article 29 of the Collective Agreement for the Urban Operations Unit, thus violating the Collective Agreement.

The Union requests a statement to the effect that the employer has violated the Collective Agreement. The Union requests that CPC be ordered not to install the BCS at the Vancouver Plant or to stop using the BCS in this facility until the Union has been provided with the notices set out in Article 29 of the Collective Agreement and clauses 29.05 to 29.10 have been applied. In addition, the Union requests that CPC be ordered to eliminate all injustices and/or adverse effects on employees, as well as any denial of their contractual or legal rights, resulting from such change. The Union further requests that CPC grant employees the full protection outline in Article 29 of the Collective Agreement. The Union finally requests that CPC be ordered to compensate employees, with interest. The Union reserves the right to request any additional corrective action and to amend this grievance.
