The Corporation has implemented a procedure in various regions that violates clause 10.03 of the collective agreement in cases where an employee wants to obtain access to medical information contained in his or her personal file. The procedure put in place by the Corporation violates clause 10.03 in that it does not allow employees to access their personal file within 24 hours and in the presence of an authorized union representative, nor during working hours.
Corrective Steps Requested
CUPW requests that the Corporation be ordered to immediately rescind its policy regarding access to personal files and take the necessary measures to ensure that any employee who so requests can access his or her personal file in the presence of a union representative within 24 hours and during working hours.
CUPW also requests that compensation be paid to any employee who has been adversely affected as a result of this violation of the collective agreement.
CUPW reserves the right to request any additional corrective action.
