The employer’s Labour Relations branch has issued a policy/directive that violates the collective agreement. In its policy/directive, the employer states that employees who volunteer to work overtime can use their seniority to select a portion of the route prior to those who have been asked to work overtime in accordance with clause 15.14 of the collective agreement.
Corrective Steps Requested
The Union requests a statement to the effect that the employer’s policy/directive violates the collective agreement. The Union also requests that the employer be ordered to withdraw and cancel its policy/directive and to apply seniority principles to all employees regardless of whether they’ve been asked to work overtime under clause 17.04 or 15.13. In addition, the Union requests that the employer be ordered to pay damages to employees for having issued a policy/directive that punishes employees who are not interested or available to work overtime on a voluntary basis.
The Union reserves the right to seek any other corrective action or to amend the corrective action requested.
