The employer has issued guidelines concerning the application of Article 54 of the collective agreement. These guidelines were sent to all CPC representatives for implementation. The guidelines concerning Article 54 and other provisions are contrary to the collective agreement. Therefore, the employer is in violation of the collective agreement.
Corrective Steps Requested
The Union requests a statement to the effect that the guidelines concerning the interpretation of Article 54 and other provisions are in violation of the collective agreement. The Union also requests that the employer be ordered to withdraw and cancel the guidelines concerning the interpretation of Article 54 and other provisions and inform all employees individually and in writing of the contents of the arbitration decision. In addition, the Union requests that all members who were subjected to and prejudiced by these guidelines be compensated. All financial compensation must bear interest.
The Union reserves the right to request any other appropriate corrective action and also reserves the right to amend this grievance.
