Annual RSMC compensation currently comprises the employees’ wages as such on the one hand and vehicle expenses on the other hand. The employer has advised the union that as part of its implementation of a bi-weekly pay system, wages will be paid with a two-week time lag. This is contrary to established practice and will result in changing the employees’ annual revenue. The employer is violating the provisions of the collective agreement and the Canada Labour Code.
Corrective Steps Requested
The union requests a statement to the effect that the employer is violating the provisions of the collective agreement and the Canada Labour Code. The Union also requests that Canada Post be ordered to reinstate the established practice, which does not entail a two-week lag, and that it amend the frequency of payment from twelve (12) to twenty-six (26) payments per year, in accordance with clause 33.04 of the collective agreement. The union further requests that employees be compensated, with interest, for any losses or damage they may have suffered as a result. Finally, the union reserves the right to request any other appropriate corrective action.
